Although specific cases, details surrounding your drug crime charge, and the sentencing judge you face will all play an important role in determining the jail term in your case, it is important to be aware of sentencing guidelines and to hire a lawyer who can help you fight for a great case result.

Although federal drug crime cases are subject to different sentencing guidelines, the punishments for state misdemeanor and felony cases can be just as harsh. Contact an attorney now if you need more information about sentencing guidelines, or if you are facing criminal charges.

Calculate Sentencing Guidelines for MI Drug Crime Case

The Michigan Sentencing Guidelines can be applied to high court misdemeanor and felony cases. In order to properly defend against criminal conviction and harsh sentencing, contact a lawyer who can help you understand the legal issues affecting your case.

In order to determine the Sentencing Guidelines that apply to your case, first determine the name of the charge you are inquiring about in the “Alphabetical Crime List.” Take note of the class and statutory maximum listed for that crime, and navigate to the “Crimes Involving a Controlled Substance” PRVs & OVs Section.

PRVs, or Prior Record Variables, relate to previous offenses on your criminal record, and will add points to your case, which will affect the sentence you face. Scroll through the PRVs in the controlled substance section, and take note of any points that apply.

OVs, or Offense Variables, are details of your charge that will affect the sentencing guidelines for your case. Scroll through the OVs and take note of all that apply to your case.

Next, navigate to the “Sentencing Grids” section, and find the grid for the charge you are facing. For example, between 50 and 225 grams of specific Schedule 1 or 2 substances is a Class B offense, and a case with a PRV level of 10-24 and OV level of 10-24 would result in a minimum guideline of 30 months jail time.
