A person is guilty of 1st degree home invasion if he or she breaks and enters a dwelling with intent to commit a felony, larceny, or assault; or breaks and enters a dwelling without permission and at any time during the breaking and entering commits a felony, larceny, or assault and is armed with a dangerous weapon; or if another person is lawfully in the dwelling at the time of the breaking and entering.

A person is guilty of 2nd degree home invasion if he or she breaks and enters a dwelling with intent to commit a felony, larceny, or assault; or if he or she enters without permission to commit a felony larceny or assault; or if he or she breaks and enters without permission and during the breaking and entering commits a felony, larceny, or assault.

A person is guilty of 3rd degree home invasion if he or she does either of the following:

  • Breaks and enters a dwelling with intent to commit a misdemeanor in the dwelling, enters without permission with intent to commit a misdemeanor in the dwelling, or breaks and enters without permission and during the breaking and entering commits a misdemeanor.
  • Breaks and enters a dwelling without permission and at any time while entering, present in, or exiting the dwelling violates any of the following ordered to protect a person or persons: a probation term or condition, a parole term or condition, a personal protection order term or condition, a bond or bail condition, or a pretrial release condition.
