Possession of a Schedule I or II Drug in Michigan

Possession of Schedule I and II substances can lead to the most serious criminal penalties, which can include substantial fines, years in prison, and a felony criminal record. Drugs classified as Schedule I and II include heroin, cocaine, LSD, and methamphetamines. While marijuana is also classified as Schedule I, different penalties apply to the drug.

If convicted of possessing a Schedule I or II controlled substance, you will face the following penalties:

  • Possession of between 25 and 50 grams can lead to up to 4 years imprisonment and as much as $25,000 in fines.
  • Possession of between 50 and 450 grams can lead to as much as 20 years in prison and $250,000 in fines.
  • Possession of 450 grams to 1 kilogram can result in up to 30 years in prison and half a million in fines.
  • Possession of over 1 kilogram can result in life imprisonment and a million dollars in fines.

Possession of Marijuana in Lansing

The penalties for possession of marijuana are different than those for other Schedule I and II drugs. If you are caught possessing any amount of marijuana, you could be faced with up to a year in jail and $2,000 in fines. If you possess an amount that suggests you may intend to distribute marijuana, however, you will face extremely enhanced punishment.
