Drug Penalties for Manufacturing Schedule 1 or 2 Drugs in Michigan

If you manufacture, create, deliver, or possess a schedule one or two drug (such as LSD, ecstasy, morphine, methamphetamines, opium, or cocaine) with intent to manufacture, hold, or distribute, you are subject to extremely detrimental criminal penalties. According to the Michigan Penal Code (333.7401), penalties are as follows:

  • Amount less than 50 grams of any mixture containing the illicit substance (felony): Jail term of up to 20 years and a potential fine of up to $25,000.
  • Amount between 50 and 450 grams of any mixture containing the illicit substance (felony): Jail term of up to 20 years and a fine of up to $250,000.
  • Amount between 450 and 1,000 grams (1kg) of any mixture containing an illicit substance (felony): Jail term of up to 30 years and a potential fine of up to $500,000.
  • Amount over 1,000 grams (1kg) of any mixture containing an illicit substance (felony): Potential life imprisonment and fines stretching up to $1,000,000.

Certain other drugs classified as schedule one, two, or three (except marijuana) are exempt from these specific penalties, but still carry a significant punishment of up to 7 years in prison and a fine of up to $10,000. Schedule 4 drugs (such as valium) can result in a 4 year sentence and a fine of up to $2,000. The cultivation or manufacture of Schedule 5 drugs (such as codeine) can result in up to 2 years in prison and a fine of as much as $2,000. If you own or use a vehicle, building, or area to manufacture a controlled substance, or possess tools used to manufacture drugs, or even provide someone with tools and equipment used to make drugs, you are guilty of a felony and will face up to 10 years in jail and a possible $10,000 fine.

Additionally, possessing a prescription form or counterfeit prescription form for any illicit substance with the intent to create or deliver prescriptions is a felony punishable by 7 years in prison.
