Negligent Homicide in Southfield

As of 2010, negligent homicide laws have been repealed, and the offense has been absorbed into other legislation. Under these laws, anyone who operated a motor vehicle in a careless or negligent manner or at an immoderate rate of speed and accidentally caused the death of another person could face up to 2 years in prison and a $2,000 fine.

Southfield Moving Violation Causing Death

Perhaps the most comparable new law replacing negligent homicide is contained in Section 257.601d, which deals with moving violations causing death. Anyone who commits a moving violation causing death can face up to a year in prison and a $2,000 fine. A moving violation is defined as an act or omission prohibited under the vehicle code or local laws, and could include running a red light or failing to stop at a stop sign. Under this section, a person can still face additional charges for the same offense, however, and in cases involving driving deemed to be reckless, even more serious criminal penalties could result.

Negligent Homicide in Southfield Replaced by Reckless Driving Causing Death

Section 257.626 deals with the other half of what was formerly known as negligent homicide in Southfield. Any person who operates a motor vehicle in willful or wanton disregard for the safety of persons or property and who thereby causes the death of another person can face up to 15 years behind bars and a $10,000 fine. This law was instated in 2010, in part to replace negligent homicide charges, and many offenses which would have previously been considered misdemeanors under negligent homicide law are now serious felonies punishable under the reckless driving causing death legislation.
