What is the Difference Between a Driver's License Suspension and a Revocation?

While a suspended and revoked driver’s license might sound similar, they are entirely separate concepts under Michigan law.

  • Suspensions are temporary and automatically expire once you satisfy specific requirements and pay the reinstatement fee.
  • Revocations terminate driving privileges entirely until the Secretary of State (SOS) is convinced you are a safe, sober driver again.

Most alcohol- or drug-related driving convictions, like second offense operating while intoxicated (OWI), result in a mandatory revocation. Under MCL 257.303, you must wait at least one year after a first revocation (or five years if another revocation occurs within seven years) before you may even apply for a restoration hearing.

Am I Eligible to Apply for a Driver's License Restoration in Monroe?

Eligibility comes down to three factors:

  • Statutory Waiting Period: Confirm that the minimum revocation term has run.
  • Clean Driving Record: Any new moving violations and alcohol or drug arrests reset the clock.
  • Documented Sobriety: You must show at least six months and preferably 12 months of complete abstinence from alcohol and non-prescribed controlled substances.

Hearings now occur via video (Microsoft Teams), in person at regional Driver Assessment branches, such as those in Dearborn, Livonia, or Clinton Township, or through a paper review.

Regardless of format, you face an administrative law judge (ALJ) who applies the “clear and convincing evidence” standard. That means the burden is on us to prove you are:

  • completely abstinent and likely to remain so,
  • a safe and responsible driver, and
  • in control of any medical or mental health conditions that could impair driving.

Because the burden is on us to prove these three things by clear and convincing evidence, the case we present to the ALJ cannot merely touch on these points. The evidence on all three must be strong.

What Do I Need to Have My Driver's License Restored?

The SOS spells out precisely what must be filed BEFORE the hearing will even be scheduled:

  • Hearing Request Application (DAIS Submission or Paper SOS-257)
  • Substance Use Evaluation (SOS-258) performed by a certified evaluator using the proper 10-panel DSM-5 format
  • 12-Panel Urinalysis with Two Integrity Variables (creatinine, specific gravity, or pH) dated within 30 days of submission
  • Three to Six Community Support Letters from friends, family, or co-workers (notarized, dated, and signed) attesting to your sobriety and character
  • Ignition-Interlock Compliance Report (if your current restricted license requires a BAIID)
  • DA-4P Medical Form, if any prescription or medical condition could affect safe driving
  • Optional Proof of Recovery Work like AA attendance sheets, counseling records, or sober-living certificates

What Happens if We Lose? Circuit Court Appeals

If the ALJ denies reinstatement, we can appeal to the Monroe County Circuit Court under MCL 257.323. The petition must be filed within 63 days (or 182 days in some rare instances) of the written denial and served on the Attorney General.

Circuit court judges may overturn OHAO decisions if they find the ALJ misapplied the law, relied on improper evidence, or issued findings unsupported by competent, material, and substantial evidence.
