CPS Claims Abuse and Neglect

Cases involving CPS are serious and require immediate legal action. When an individual reports suspicion of child abuse or neglect, a CPS officer will begin investigating as soon as possible, assuming the claims are 100% true. If you or a loved one has been accused of child abuse or neglect, you’ll need the help of a defense attorney to prove your innocence. The team at Grabel & Associates has ample experience defending parents and protecting their parental rights. We understand that miscommunication happens, and believe that you and your family should not suffer because of an inaccurate report. Children are often the true victims of false allegations, and may even be forcibly removed from their homes as a result. Our CPS attorneys are committed to doing everything in their power to protect the best interest of the child or children in a home, and will aggressively work to uncover the truth and show that you are a suitable parent or guardian. To learn more about how partnering with a lawyer could be beneficial in your case involving CPS, give Grabel & Associates a call right now or contact us online. We’re available 24 hours a day, 7 days a week to provide you with a free initial cause consultation and to start building your defense.

What Happens When Child Abuse and Neglect are Reported?

Anyone can report suspicion of child abuse and neglect, but mandatory reporters are individuals that are lawfully obligated to call in any signs of abuse or neglect. Child Protective Services, a staff within DSHS, will receive the report and determine if it meets the criteria for an investigation. If it does, an officer will begin investigating the details of the case. He or she will visit the home and conduct interviews with the caretaker, child, and anyone else involved. In some cases, police also get involved in the investigation. If the child has been harmed, or is in any danger of being harmed, he or she may be placed in protective custody. This means that the child will be moved to a foster home or a relative’s house for no more than 72 hours, excluding holidays and weekends. In extreme cases of abuse or neglect, the child may be permanently separated from the parents. This termination of parental rights legally frees the child through a court procedure, removing all parental obligations. The parents may also choose to voluntarily give the child up for adoption. This is referred to as relinquishing parental rights.

Fighting Child Abuse and Neglect Accusations

If CPS is investigating you, don’t ignore the problem and assume that it will go away. An officer may never uncover the truth, potentially causing great harm to you and your family. The sooner you call a CPS defense lawyer, the better your chances will be of receiving a favorable outcome. Your lawyer will prepare you for the investigation stage of your case and help you prove your innocence. It’s important to remember that you are not obligated to comply with a CPS officer’s requests. Be courteous and polite, but never allow a CPS worker into your home without a warrant before consulting an attorney. Investigators may be pushy and try to convince you that you are legally required to meet all of their demands. This may lead to an unjust outcome in your case, potentially causing great harm to you and your children. If you need help handling a CPS investigation, call the team at Grabel & Associates. We know what it takes to be successful in a case involving CPS and will walk alongside you every step of the way.
