After a judgment is entered, the appellant has 21 days to file a claim of appeal, unless a rehearing or reconsideration was considered. If your case has been reconsidered, you have 21 days from the date your motion for a new trial or judgment notwithstanding verdict was denied, or motion for rehearing, reconsideration, or other post-conviction relief was denied, if the motions occurred within the initial 21 day period.

Michigan court rules state that in order to file an appeal by right, you must file a claim of appeal form, along with other documents, which can include:

  • A copy of the judgment or decision
  • A copy of the certificate of the court reporter or a statement that either the transcript has been ordered, or that there is nothing to be transcribed
  • A copy of a written request for a certified copy of the record to be sent to the circuit court
  • A true copy of any bond filed
  • Proof that money, documents, property, etc. have been delivered as required
  • A copy of the register of actions
  • Proof that the appeal fee has been paid to the appropriate court
  • Proof that a copy of the claim of appeal and other documents were served on all parties, courts, and agencies entitled to notice of appeal
