Zero Tolerance DUI Law in Michigan

As outlined in the Michigan Vehicle Code, it is illegal for a person who is under the legal drinking age to operate a motor vehicle after drinking alcohol. Though the legal limit is technically 0.00%, usually underage offenders can be convicted if they register a BAC over 0.02%. If your BAC is between 0.02% and 0.08%, you will be charged with a Zero Tolerance DUI, though a BAC over 0.08% can still lead to regular OWI charges and the corresponding penalties.

Exceptions to the Zero Tolerance Law

There are only three exceptions recognized by Michigan law that allow a person under 21 to consume alcohol. If the alcohol was consumed as part of a religious ceremony such as communion, a BAC under 0.08% may be allowed. If government or police-related work, an exemption required alcohol consumption could be made. In addition, alcohol consumption for school, such as a culinary college, could lead to exemptions, especially in borderline cases.
