Criminal Sexual Conduct (CSC) in the first degree charges are filed when sexual penetration occurs with an alleged victim under the age of 13. If the defendant and alleged victim are related or in the same household or other conditions including the use of force or coercion apply, cases involving alleged victims under the age of 16 can also result in first degree CSC charges. If contact occurs without penetration, CSC charges in the 2nd degree can result. If the case involves a person between the ages of 13 and 16 without any of the conditions set out in the Michigan Penal Code, charges of third degree CSC, 4th degree CSC, or Statutory Rape could apply.
While persons under the age of 17 will not likely face as serious of penalties as adult offenders, the restitution, probation, rehabilitation, and other penalties faced could be severe. Contact Grabel & Associates right away if you or your child has been accused of CSC in Michigan.
If you are sentenced in juvenile court, the penalties set may be more focused on rehabilitation than punishment. This doesn’t mean that penalties will not be severe or life-changing, however, and only by working with a skilled defense lawyer can you ensure your best interests are sought throughout the criminal process. Juvenile courts are a division of the Michigan family court system, and while the court may be focused on alternative sentencing, it should never be assumed that the court is on your side. Police and prosecutors will still be working to secure a conviction, and if the offender has a previous history or is nearing the age of 17, sentencing as an adult is possible.
