Temporary Child Relocation During a CPS Investigation

Upon receiving a report of suspected abuse or neglect, the CPS worker will visit the home of the alleged victim, interview the individuals involved, and review all the relevant documents. If the CPS worker finds out that the child is currently facing danger of serious harm, or that the caregiver is unable to protect the child from harm and there are no reasonable efforts CPS can make to protect the child in his or her home, the worker may issue an emergency, temporary relocation of the child. The child may be placed in a foster home, or with family or friends if pre-arranged. If CPS temporarily removes your child without a hearing, an emergency hearing must be scheduled as soon as possible. Two weeks after removal of the child, an Adversary Hearing will be scheduled. During this hearing, the court will enter temporary orders regarding the child’s return to the parent or guardian if it is deemed safe to do so. If the child cannot safely be returned to his or her home, CPS will outline temporary orders will state your rights as a parent or guardian, visitation, child support, and any services that are required to ensure the wellbeing of the child.

Permanent Child Relocation Following a CPS Investigation

Sixty days after the Adversary Hearing, the court will hold a Status Hearing. During the Status Hearing, the child’s status will be reviewed and a permanent plan will be developed. Over the next two years, five more hearings will take place to ensure the plan is benefiting the child. The court has until day 720 to enter a final order regarding the conservatorship of the child.
